These Terms of Service (“Terms”) govern your access to and use of the 3D Magic website, 3D generation tools, public model catalogue, and related services (together, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 18 years old and able to enter into a binding agreement to use the Service. If you use the Service for an organization, you represent that you have authority to bind that organization to these Terms.
You are responsible for the accuracy of your account information, activity performed through your account, and keeping access to your email and authentication methods secure. Tell us promptly at [email protected] if you believe your account has been compromised.
2. What 3D Magic provides
3D Magic lets users discover, view, generate, edit, prepare, share, and download 3D models and related assets. Some features use third-party artificial intelligence models and infrastructure. Outputs can be incomplete, inaccurate, unsuitable for printing, or similar to content produced for other users.
Features, supported formats, model providers, usage limits, prices, and availability may change. We may introduce, modify, suspend, or discontinue parts of the Service where reasonably necessary, including for security, maintenance, legal, or provider reasons.
3. Your content and generated outputs
You retain any rights you already hold in prompts, images, 3D assets, instructions, and other material you submit (“User Content”). You grant 3D Magic a worldwide, non-exclusive license to host, copy, process, transform, transmit, and display User Content only as needed to operate, secure, improve, and provide the Service and the sharing or publication choices you make.
You must have the rights and permissions needed to submit User Content and to instruct us to process it. Do not upload confidential material or personal information unless you are authorized to do so and accept the processing described in our Privacy Policy.
As between you and 3D Magic, we do not claim ownership of generated outputs. Rights in AI-generated material can be uncertain and may depend on applicable law and provider terms. We do not guarantee that an output is unique, protectable, non-infringing, or safe for a particular commercial use. You are responsible for reviewing an output before using or distributing it.
4. Public catalogue and third-party models
The catalogue can include user-published models and models or metadata obtained from third-party public sources. A model being publicly accessible through 3D Magic does not mean that it is public domain, free of third-party rights, or suitable for every use. Public access by itself does not grant you a license beyond any license clearly supplied by the relevant rights holder.
You are responsible for checking the source, license, attribution requirements, trademark restrictions, and other rights before copying, printing, modifying, selling, or redistributing catalogue content. We do not warrant ownership, provenance, licensing, or non-infringement of third-party catalogue items.
If you believe content available through the Service infringes your rights, email[email protected] with your contact details, identification of the work or right at issue, the relevant 3D Magic URL, the basis for your claim, and a statement that the information supplied is accurate. We may remove or restrict access while we review the request.
5. Acceptable use
You may not use the Service to:
- break the law, violate another person's rights, or facilitate harmful conduct;
- create or distribute sexual exploitation, content involving minors, non-consensual intimate material, targeted harassment, hateful abuse, or credible threats;
- upload malware, probe or bypass security, overload the Service, automate abusive access, or interfere with other users;
- impersonate another person, misrepresent provenance, commit fraud, evade billing, or create accounts to avoid a restriction;
- reverse engineer protected parts of the Service except where the law expressly permits it, or use Service output to misleadingly suggest endorsement by 3D Magic.
We may investigate suspected violations and remove content, limit features, suspend an account, or terminate access where reasonably necessary to protect users, providers, 3D Magic, or the public.
6. Credits, subscriptions, and payments
Paid generation features use credits. Credits are a limited, non-transferable right to use eligible Service features; they are not money, stored value, or redeemable for cash. Prices, included credits, and billing intervals are shown before purchase. Payments are processed by Stripe.
A subscription automatically renews at the disclosed interval until you cancel it. You can cancel through the Stripe billing portal available from your account. Cancellation takes effect at the end of the current billing period, and you retain access until then. Plan upgrades may take effect immediately without proration; scheduled downgrades take effect at the next billing period as shown in the Service.
Credit packs are one-time purchases. Purchases are non-refundable except where required by applicable law or where we approve an exceptional manual review. If a generation fails before delivering the paid result, the Service is designed to release or return the affected credits. Contact [email protected] if the credit balance does not recover or you believe a charge was made in error.
Promotional and free-trial credits may be offered to eligible accounts. They have no cash or monetary value, are not transferable or redeemable, and do not by themselves create a paid subscription. We may change, suspend, or withdraw an offer and its eligibility, amount, or availability for future claims. A later campaign change does not revoke promotional credits already granted to your account.
You authorize us and Stripe to charge the payment method you provide for purchases, renewals, taxes, and fees disclosed at checkout. We may suspend paid features when payment fails or a charge is reversed.
7. 3D Magic intellectual property
The Service, including its software, interface, branding, original illustrations, documentation, and compilation, is owned by or licensed to 3D Magic and protected by applicable intellectual-property laws. These Terms give you a limited, revocable, non-exclusive right to use the Service in accordance with them; they do not transfer ownership of the Service or 3D Magic branding.
If you send feedback, you allow us to use it without restriction or compensation, provided we do not identify you publicly without permission.
8. Suspension and termination
You may stop using the Service at any time and cancel an active subscription as described above. You may request account deletion by contacting [email protected].
We may suspend or terminate access for a material breach, unlawful or harmful activity, security risk, non-payment, provider requirement, or discontinuation of the Service. Where practical, we will give notice and a chance to remedy. Provisions that by their nature should survive termination—including payment obligations, licenses needed for previously shared content, disclaimers, and liability limits—will survive.
9. Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, 3D Magic disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, and error-free operation.
3D models can contain structural, dimensional, licensing, safety, or manufacturing problems. You are responsible for validating models, slicer settings, materials, printer operation, and suitability before fabrication or real-world use. The Service is not a substitute for professional engineering or safety advice.
10. Limitation of liability
To the maximum extent permitted by law, 3D Magic will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from the Service.
To the maximum extent permitted by law, 3D Magic's aggregate liability for claims relating to the Service will not exceed the amount you paid to 3D Magic during the twelve months before the event giving rise to the claim or USD 100, whichever is greater. Nothing in these Terms excludes liability that cannot lawfully be excluded.
11. Changes, governing law, and contact
We may update these Terms as the Service or legal requirements change. We will update the date shown on this page and provide additional notice when a change is material. Continued use after the effective date means you accept the revised Terms.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory local law applies. Questions, billing issues, and legal notices can be sent to [email protected].
